Motion for insanity defense filed for Fort Wayne mother accused of killing her two children

ELKHART COUNTY, Ind.– A Fort Wayne mother’s attorney filed a motion to use an insanity defense when the woman goes to trial for allegedly murdering her two children.

The suspect’s public defender filed a Notice of Defense of Mental Disease or Defect motion on Thursday, which means they will argue she was not responsible for her actions.

An Amber Amber Alert was issued for the children on September 26 after they were believed to have been abducted by Pasztor from a home in the 7000 block of U.S. 33 in Fort Wayne around 6:20 a.m.

According to court documents, Pasztor flagged down an Elkhart officer directly behind the police department at approximately 5:25 p.m. Pasztor told the officer that her children, Liliana Hernandez, 7, and Rene Pasztor, 6, were dead and in the back seat of her car.

An officer asked Pasztor what happened, and she said she “smothered them,” according to court documents. Pasztor was detained and found to have a warrant for her arrest out of Fort Wayne.

If convicted, she faces life without parole.
