CARMEL, Ind. (September 15, 2015) – FBI agents conducted investigations at several locations Tuesday, including the American Senior Communities building on the south side of Indianapolis and the home of American Senior Communities CEO James G. Burkhart in Carmel.  Sources tell CBS4 the investigation is centered around possible Medicare and Medicaid fraud.

FBI agents arrived at Burkhart’s house in the 700 block of Suffolk Lane around 8 a.m.

Agents also arrived at the American Senior Communities building in the 6900 block of South Gray Road shortly thereafter.

CBS4 reporters witnessed the gathering of boxes of materials taken by the FBI and put into cars and vans.

In addition to the FBI, identifying jackets worn by the Medicare Fraud Control Unit and by the IRS have been spotted at the Carmel scene.

The MFCU is run out of the State Attorney General’s office.

FBI spokeswoman Wendy Osborne released this statement:

“The FBI is participating in investigative activity in Carmel today, the nature of which can’t be disclosed at this time.”

Osborne also said the FBI searched at least a dozen other locations today related to the raid.

According to their website, American Senior Communities operates more than 90 senior facilities in Indiana and Kentucky. CBS4 learned late Tuesday afternoon that 80 are owned by the Health and Hospital Corporation of Marion County and operated by American Senior Communities.

American Senior Communities CEO James Burkhart serves as chairman for the Indiana Health Care Association.

The Indiana Health Care Association sent out this statement:

“The Indiana Health Care Association just learned of the investigation this morning. We will continue to gather information as it becomes available.  Right now, our most important priority is the care of the Hoosiers in our 330 member centers across the state.”

Curt Brantingham, spokesperson for Health & Hospital Corporation of Marion County, released this statement Tuesday afternoon:

Health & Hospital Corporation of Marion County (HHC) is aware of the investigation of James G. Burkhart, CEO of American Senior Communities. American Senior Communities is one of the largest nursing home management companies in the state of Indiana. HHC has contracted with ASC to operate and manage nursing home facilities owned by HHC.

HHC is assured that HHC and its employees are not the target or subject of any investigation and that this investigation is not related to the care that any patient has received at any of HHC’s nursing homes. Moreover, this investigation will not impact the care that residents receive at any of HHC’s nursing homes.

HHC is working closely with the U.S. Attorney’s office and the FBI to assist and cooperate. Because it is an ongoing investigation it would be inappropriate for us to comment further. Any additional questions should be referred to the US Attorney’s office.

Burkhart released the following statement through his attorney, Larry Mackey:

Thorough oversight of health care costs in this nation is in every citizen’s interests and ASC will be an active partner with the government in this investigation.  ASC cares for thousands of residents in scores of facilities across Indiana and has built a decade long record and reputation for excellence in caring for those most in need. We will keep our focus on our residents while we cooperate fully in this cost review.

Employees at American Senior Communities told CBS4’s Kendall Downing as of Tuesday afternoon they were unaware of what was happening.

As of Tuesday afternoon, CBS4 had not received formal comment from American Senior Communities.
