Former IndyGo driver accused of stealing money from rider’s estate after his death

INDIANAPOLIS, Ind. (Dec. 1, 2015)— A woman is accused of stealing tens of thousands of dollars from a man she befriended while she worked as an IndyGo bus driver.

Charmaine Leake was charged with one count of felony forgery and eight felony counts of theft.  She was arrested in Georgia last month.

Leake is accused of befriending Donald Gallagher, who frequently rode her bus over a course of five years. Following Gallagher’s death in 2010, Leake was named the personal representative of his estate, meaning she was responsible for seeing that the estate was properly and promptly administered to the rightful heirs.

However, it is alleged Leake opened several accounts at various banks under the name “Estate of Donald Gallagher” and used money from Gallagher’s estate for her personal gain. According to court documents, Leake stole more than $44,000 to pay for several personal expenses, including rent, car repairs and car insurance.

According to recorded statements, Leake said she used $6,000 of Gallagher’s money to pay consultants to search for the heirs to his estate. However, detectives determined the consulting company Leake named, JRW Consultants, was not real.

Leake is scheduled to appear in court for a pre-trial conference on Jan. 7 at 1:30 p.m.
