Police: Pendleton man was driving drunk with one-year-old son

HENRY COUNTY, Ind. (September 2, 2015) – A Pendleton man was arrested on felony OWI charges after police found he was driving drunk with his one-year-old son in the van.

Indiana state troopers were working traffic enforcement on I-70 in Henry County in conjunction with Operation Pull Over, “Drive Sober or Get Pulled Over.”

Two troopers had a vehicle stopped on I-70 east bound around the 130 mile marker for a traffic violation, when he saw a van swerve over and nearly hit his squad car.

The officer gave chase and stopped the van around the 131 mile marker.

The officer suspected the driver, Zachary Gross, 31, of Pendleton, was driving impaired.

Further investigation revealed that Gross was operating his van with a BAC more than twice the legal limit.

In addition, Gross had his one year old son in the van with him.

Gross was arrested and charged with operating while intoxicated with a passenger less than 18 years of age, a level 6 felony, and operating while intoxicated with endangerment,  a class A misdemeanor.

Gross was transported to the Henry County Jail, and the child was transported and released to his mother.
