Central Indiana man claims former officer attacked him

MARION COUNTY (March 27, 2015)-- A central Indiana man was allegedly beat up by a retired police officer after he was involved in a minor fender-bender.

"We should have just exchanged phone numbers and gone on with our day," said Harry Smith.

However, Smith exchanged fists with the man he rear-ended rather than digits.

"My nose is broken, my eyes are swollen and my clothes are covered in blood," said Smith.

The incident happened March 22, at the intersection of Stop 11 and Madison Ave.

"All I know is that he came out of the car and started bashing me," said Smith.

Smith says moments after bumping the car in-front of him, a man got out of the passenger side-door and aggressively walked towards him.The man started hitting Smith and threw him out of his car, according to Smith.

Smith fled the scene in a strangers car, according to police. He later returned and spoke with officers.

 "I just got the crap beat out of me and now all the sudden he's saying he’s a cop. I didn't know what to think," said Smith.

According to police reports, the other man involved is a retired Greenwood Police Officer. Leaders with GPD say he retired in 2006 for medical reasons. FOX59 has decided to withhold his name because no charges have been filed.

"I said 'somebody call the cops' and that's when he said, 'You don’t have to call them; I am a cop,'" said Smith.

Former officers don't hold police powers, according to the Greenwood Police Department. Retirees are often presented with a commemorative badge.

Police reports say the former officer suspected Smith of being intoxicated and only got physical to prevent him from driving away.

"That’s 100 percent untrue. It was little fender bender and now my whole life got turned upside down," said Smith.

An independent witness told police that she saw the accident and observed the former officer "get out of the car and start yelling at the other driver and appeared very angry."

"I’m scared to death. I don’t know who to trust anymore. I should be able to trust officers," said Smith.

CBS4 reached out to the former officer involved in this incident, however, we have yet to hear back.
