Judge says Indiana high school is not permitted to perform live nativity scene

ELKHART, Ind. (December 2, 2015) – U.S. District Court Judge Jon DeGuilio has banned Concord High School in Elkhart from performing a live nativity scene at their 2015 Christmas Spectacular.

Judge DeGuilio granted a preliminary injunction in a federal lawsuit against the high school which alleges that the school’s annual Christmas pageant is overtly religious in nature and unconstitutionally endorses Christianity.

A hearing has been set for the case on January 7, but the 2015 Christmas Spectacular debuts before then with shows beginning December 11. The judge granted the preliminary injunction until a final decision can be made in the case.

Concord High School’s annual Christmas Spectacular originated in 1970.
